  • An agreement regarding the revision of the conditional use permit (CUP) of the Butler County Landfill seems to have been reached during the County Commission meeting Tuesday morning.
    Following the original mention of a change in the CUP several weeks ago, which would allow the land located south of the current landfill to be used as cover soil, several neighbors have voiced concerns over what havoc the change would wreak not only on their lives, but on the environment surrounding the current landfill.
    Currently, the cover soil for the landfill is being taken from a small area north of the site, which also holds a construction demolition waste area.
    Upon hearing the concerns of the neighbors, the commission members took a period of approximately two weeks in order to add their stipulations to the outstanding CUP. Some of these stipulations were: screening, internal roads, dust control, setbacks, road conditions and operating perimeters.
    “We have the ability to continue borrowing from our north property site for five to seven more years,” explained Director of Public Works Darryl Lutz. “I want to be cautious that we don’t over-excavate that site because we do have a construction landfill site and we will need soil for that.”
    Because the site is not scheduled to begin excavation for several more years, the berms, which are stipulated to be in place before any dirt is moved, were discussed with the present neighbors.
    “The berms need to be planted and completed before the digging starts,” said neighbor Vicky Swimmer.
    “Let’s get the berms up and done so they’re looking nice,” added neighbor Jane Mosteller.
    “I don’t think it would be unreasonable to place some kind of modest shielding along the west side,” commented Commissioner Ed Myers.
    The commission, upon further discussion, added the stipulation for the earthen berms to be placed across the road the neighbors’ homes along the view line in order to block the view of the excavation completely. Altogether, the berm will be a half mile long and will include both native grasses and random trees in order to aid in sound and dust control.
    The further discussion of the landscaping layout was placed on the agenda for a later date so the commission would be able to approve more intricate details.
    In addition to the revision of the CUP for the landfill, a rezoning of the present land was also brought before the commission. The rezoning would allow the landfill use of a six-acre strip of land that currently lies between the old landfill, which was closed in 1995, and the new landfill the county is currently using.
    Page 2 of 2 - With the addition of the strip of land to the landfill, the projected life is extended from 40 years to more than 60 years.
    “When we purchased the property for the new landfill and started through the permitting process in 1995, we had intentions of trying to separate the old from the new,” explained Lutz. “However, the KDHE told us during the permitting process, they would not allow us to completely separate the two areas. They would remain as one. Since we are not allowed to separate the two, why not begin filling in this gap before we open a new cell?”
    Lutz further explained the current landfill, which is averaging 160 tons of new waste per day will expand from 70 to 76 acres, but it will increase the capacity of this landfill by 40 percent. This is due to an increase in height of 50 feet, which is regulated by the KDHE.
    “We have the opportunity to extend the life of our current landfill and we have to have a place to put our trash,” commented Commissioner Jeff Masterson. “I am supportive of this application, but we need to take some steps to make sure we’re being good neighbors.”
    The rezoning of the six acres within the landfill itself was then tabled in order to further discuss the details in regards to the CUP.
    The commission also:
    • approved an application by Wilson and Nina Smith to rezone approximately 23.7 acres from an AG-40 Agricultural classification to an RE Residential Estate classification.
    • approved a request by Wilson and Nina Smith to split a parcel of property containing approximately 23.7 acres into two parcels.
    • approved an application by Joseph Eaton to rezone approximately 20 acres from an AG-40 Agricultural classification to an RE Residential Estate classification.
    • approved a request by Joseph Eaton to split a parcel of property containing approximately 20 acres off of 159.1 acres.
    • approved an application by Dennis Christianson to rezone approximately 38.7 acres from an AG-40 Agricultural classification to an RR Rural Residential classification.
    • approved a request by Joshua and Marki Huston for a Mortgage Lot Split with APO in order to separate a homestead and 10 acres from a parcel containing approximately 53.1 acres.
    • approved a recommendation to the City of Augusta regarding the application by McClure Bros. Farms LLC for a conditional use permit to allow temporary storage of rubber matting used in pipeline construction, with the proposed conditional use in conformance to the Butler County Comprehensive Plan.
    • approved the declaration of disaster emergency for Butler County from July 22 to Aug. 16 as stated in Resolution 13-41.
    • approved the award of bids for Culvert Letting No. 68 for the construction of seven reinforced concrete box structures throughout Butler County.
